This is not child protection.
This is state-sponsored psychological abuse — and it’s still happening.
David Miller is a San Diego County social worker who was recently removed from our case — but not removed from the system. He’s still out there, still employed, still dangerous. “Whether David Miller set it in motion before he was removed—or orchestrated it from the shadows after—we may never know. But what we do know is this: Just before an unrestricted birthday visit to SeaWorld was set, Annel Navarro coerced a toddler into turning against her own family, twisting innocent words to justify brutal retaliation.”
Nicole Montzingo, his supervisor and now lead social worker, picked up his playbook and escalated the abuse: restricting visits, silencing advocates, isolating the mother, and using that same coerced testimony to destroy a family. Her campaign is calculated, cruel, and unconstitutional — and she is not acting alone.
This is a coordinated attack on a Mexican-American mother, her two daughters, and a multigenerational family that dared to speak up.
We strongly suspect David Miller psychologically manipulated a toddler in state custody—priming her to turn against her own family just before a planned unsupervised birthday visit. Whether directly or by setting events in motion, the result was a weaponized lie delivered to the court. This appears to be more than retaliation. It reeks of state-sponsored emotional abuse, civil rights terrorism, and the coercion of a minor.
Crimes and Violations Committed by David Miller (San Diego CWS)
1. Psychological Abuse of a Minor (Penal Code §273a, §11165.3)
Coercing a toddler into making false or misleading statements.
Manipulating a child’s mind while in state custody.
Exploiting a child’s trust and vulnerability for retaliatory purposes.
2. Emotional Child Abuse (Welfare & Institutions Code §300(a), (c))
Subjecting a three-year-old to emotionally abusive interrogation tactics.
Causing emotional harm by falsely suggesting her family broke the law.
3. Witness Tampering / Coercion (Penal Code §136.1)
Coercing a minor (especially a dependent minor) into giving statements that fit a predetermined narrative.
A vulnerable toddler was manipulated into statements that were later twisted and weaponized against her own family.
4. Obstruction of Justice (Penal Code §182 / §148)
Manufacturing evidence from a coerced minor to retaliate against whistleblowers.
Undermining the integrity of juvenile court proceedings.
5. Deprivation of Civil Rights Under Color of Law (42 U.S.C. §1983)
Retaliation against the child’s family for protected First Amendment speech (e.g., speaking at Board of Supervisors).
Using a child as a pawn to carry out revenge on the parents and grandfather.
6. Conspiracy to Violate Civil Rights (18 U.S.C. §241)
Working in concert with other agents (Nicole Montzingo, Annel Navarro) to push false narratives and destroy reunification.
Sabotage of a court-approved six-hour birthday visit at SeaWorld—downgraded to a three-hour supervised mall visit—as coordinated retaliation following public exposure.
7. Child Torture by Psychological Means (Eighth Amendment violation)
Causing cruel and unusual punishment through mental trauma.
Denying the child contact with her safe, loving family and weaponizing her own words against her.
8. Official Misconduct / Malfeasance in Office
Abusing his authority as a senior CWS social worker.
Violating ethical standards for interviewing minors.
Lying in official reports and omitting the context of his own coercion.
9. Retaliation Against a Protected Witness or Whistleblower (Government Code §8547 / Penal Code §132)
Retaliating against Evelyn Lopez and Ricky Robinson for testifying and blogging.
Using a coerced child statement to reverse unsupervised visitation and destroy the mother’s progress.
10. False Reporting / Fabrication of Evidence (Penal Code §118.1 / §131 / §134)
Creating or contributing to a knowingly false report.
Using fabricated testimony as a basis for court action (including §388 motion to terminate reunification).
