When social workers knowingly commit crimes against humanity and children out of retaliation, they are no longer protectors of the vulnerable — they have become perpetrators of abuse. Retaliation is not child welfare; it is systemic corruption that must be exposed and stopped.
David Miller, a San Diego social worker removed for psychological abuse—particularly against the children’s mother—never truly left the case. He continues to operate from the shadows, while his supervisor, Nicole Montzingo-Avila, was unleashed to carry out even harsher retaliation.
She cut the grandfather’s visits with his granddaughters in direct retaliation for public exposure and dissent. This is not child protection — it is institutional abuse, enforced silence, and the deliberate use of children as leverage to keep the machine running.

San Diego County officials — including Judge Alexander M. Calero, County Counsel Jesica Nicole Fellman, Guardian ad Litem Supervisor Nicole Fellman, social workers David Miller, Nicole Montzingo-Avila and Annel Navarro, and a caregiver who has broken every rule of caregiving — engaging in deceit, manipulation, and efforts to unlawfully keep and alienate the children from their blood family participated in actions that resulted in the termination of Evelyn Lopez’s parental rights, despite clear evidence of an undeniable love and bond between Evelyn and her daughters.
In the process, they weaponized the family’s three-year-old child, coercing statements from her through the actions of an untrained social worker with no forensic or psychological expertise. This unethical conduct compounded the trauma inflicted on the children and their mother, reflecting a gross misuse of authority and a disregard for professional and constitutional standards.
URGENT UPDATE: February 10, 2026
On February 10, Nicole Montzingo-Avila took the stand and declared the grandfather a danger to his own grandchildren — despite prior written reports documenting a bond — testimony that immediately formed the basis for a restraining order we contend is retaliatory.
In open court, when asked directly, “So he is a danger to his grandchildren?” her response was: “Yes, you are.”
There has been no criminal finding. No substantiated abuse. No documented evidence of harm.
Guardian ad Litem Supervisor Nicole McConn aligned with that position. County counsel (name unknown) reinforced it. Caregiver Norma Olivares’ narrative echoed it. Judge Alejandro Morales accepted it.
A bonded family member was reframed as a threat through testimony that conflicts with the written record.
