When the family spoke publicly at the San Diego Board of Supervisors meeting on June 24, 2024, the agency reacted immediately.
Within 1–2 days, a brand-new investigation suddenly appeared — not because of new concerns, but because the mother dared to speak the truth in public.
The assignment was given to social worker Annel Navarro, operating under the same chain of command that had just been confronted: Nicole Montzingo-Avila, supervisor; David Miller, the previous worker who framed the narrative; Kimberly Giardina, Director of Child & Family Well-Being and the highest authority over the unit; and Alfredo Guardado, whose leadership remained part of the county operation pushing this case away from reunification.
Nothing about what followed was hidden. They documented it themselves.
Navarro’s addendum report shows what happened next. A three-year-old toddler was subjected to questioning the family says was coercive and leading. A previously documented medical issue involving pain while urinating was reframed into an accusation of abuse without a new medical finding, forensic interview, or forensic examination supporting that change.
At the same time, months of successful unsupervised visits were suddenly revoked even though there was no new incident during those visits. The section 388 termination request then relied on unverified toddler speech, no corroboration, no new medical findings, no forensic examination, and case-worker interpretation presented as fact.
The entire process remained inside the same chain of command that had just been publicly confronted. There was no independent outside review separating the new investigation from the people whose conduct the family had just exposed at the Board of Supervisors.
The names are contained in their own record: Annel Navarro, Nicole Montzingo-Avila, David Miller, and the county leadership responsible for supervising the case, including Kimberly Giardina and Alfredo Guardado.
What makes the addendum so important is that this is not a story reconstructed years later. The agency’s own paperwork records the escalation in real time: public criticism, a new investigation, changed allegations, the loss of unsupervised visitation, and another push toward terminating reunification.
A child pressured. A narrative changed. A family punished. Rights violated. Reunification sabotaged.
Every contradiction, escalation, manipulation, and decision used against this family is preserved in their own record. They documented the very conduct the family is challenging.
