The Department of American Indian Studies teaches about history, culture, family, community, government power, and the consequences when institutions decide they know what is best for other people’s children. Then one of its own lecturers, Judge Devon L. Lomayesva, terminates the parental rights of Malaika and Xayah’s mother and father, severing two little girls from an entire living family despite documented trauma and expert testimony warning of catastrophic harm.

Judge Lomayesva says she follows her heart. A judge’s heart is not the law. History is full of authorities who believe their convictions justify what they do to families and children. That is precisely why judges are bound by law, evidence, due process, and constitutional limits—not personal conviction.

Letters have been sent to this department raising serious questions about what is happening to Malaika and Xayah and their family. Whether anyone there chooses to respond or remain silent, those questions do not disappear. Now the public is being placed on notice as well.

Malaika and Xayah have a family. They are surrounded by a family that continues fighting for them while the separation and catastrophic harm continue. The record continues to grow, and so does the number of people being called upon to answer for it.

History does not forget what institutions do to children and families—and neither will we.
